temperature in 25 years. folks, we're just getting started with this heat wave. calling it hot isn't enough. this morning, it's an inferno. record highs, not just broken, but shattered. across the country, more than 1,000 broken or tied just this week. so hot that in sands springs, oklahoma, they didn't fry an egg, they baked a pizza. in the best heat stunt we've seen so far, travis and jesse lawly, owners of minuteman pizza, cooked this one in the front of their suv. >> the dash is already hot. >> reporter: 3 hours at 107 degrees. >> tastes pretty good. >> reporter: in chattanooga, four firefighters passed out fighting a fire. the combination of the heat and flames, too intense. and in chicago, the most master at this chicago restaurant, had to deal with the 100-degree temps outside, plus a hot oven. >> we're trying to heat up the oven to make the fish. then, we do the smoking. i'm already half-baked.

>> reporter: but this truck driver in joplin, missouri, may have the best job of all in a heat wave. at least while he's loading his trailer, stacked with ice. >> it feels great. once you go back out, that's where it feels -- you go back to reality. >> and stay up with our abc stations for the watches and warnings that will come out today for air quality, heat advisories, heat index. we show you the ones that are up this morning. and they're in 24 states, by the way, dealing with this heat. it's not normal summertime heat, folks. you need to do all of the precautions. sometimes we say too much when it's regular summertime heat. but this time, it's for real. and it's not going away, all weekend long. >> all right. sam, as you know, those high temperature, really making it hard to fight those fires out west. the governor of colorado calling the blazes there the most destructive ever. and president obama has changed his schedule to tour the devastation himself today. alex perez is on the ground there in colorado springs. alex?

>> reporter: good morning, robin. authorities have been able to get into the burn zone and assess the damage. one person is dead and another has been reported missing. >> look at that. >> reporter: from the ground, this colorado community is a wall of flames. >> the whole neighborhood. >> reporter: from above, a war zone. >> just can't believe how totally devastated that is. >> it's like someone just took this thumb and smudged each house out, one by one by one. >> reporter: more than 20,000 homes still threatened. nearly 350 already burned. more than 85% of the fire still not contained. >> i don't try to say, did i deserve this? no. it's fire. it's called wildfire, right, for a reason. >> reporter: police continue to guard evacuated areas, after two arrests for looting, causing tempers to flare. >> you don't have the authority to tell me i can't go back in my house. i looked this up. i'm not flying off the cuff here. i have rights as a property

owner. >> reporter: in an elusive interview, el paso county undersheriff, paula presley, tells abc news, while officials don't know the cause of the fire, they are treating it as arson. >> anytime we have a fire of undetermined origin, we're going to treat it as an arson. to investigate it. >> reporter: you grew up here. >> absolutely. i'm a native here. i've never seen anything like this. >> reporter: now, firefighters did get a break from the weather yesterday. the temperatures were not as hot and the winds were not as strong. they're hoping for more of the same today. george. >> help them get it under control. alex, thanks very much. now to the history-making day at the supreme court. it gave the president a huge victory yesterday, with a surprise ruling by chief justice john roberts that obama's law is constitutional. it could define the legacy of both men. and it is one that will certainly affect all of us. terry moran covers the supreme court. good morning, terry. >> reporter: good morning, george. today, this magnificent building belongs to the tourists.

the justices have scattered for their summer plans. chief justice roberts is at a resort in pennsylvania. some of the others heading overseas. but what they did yesterday, the historic opinion, the aftershocks from that have just begun. this morning, the entire country is still reckoning with the fallout from this moment. when the ruling came down, no one expected that it would be chief justice john roberts who would cast the deciding vote and write the opinion upholding the president's health care law. roberts' opinion reframed the law to make it constitutional. ruling that while congress can't simply require americans to purchase health insurance, it can tax americans more if they don't purchase it. and that's what the law does. and that's how roberts saved it, even while suggesting he didn't like it. it's not our job to protect the people from the consequences of their political choices, he wrote. >> i think he made everybody a little bit angry. and made many people very happy.

and looked like a statesman. >> reporter: president obama declared victory. >> good afternoon. >> reporter: and took up the task of convincing skeptical americans that his law will work for them. >> well, it should be pretty clear by now that i didn't do this because it was good politics. i did it because i believed it was good for the american people. >> reporter: mitt romney came right back at him. >> obama care was bad policy yesterday. it's bad policy today. obama care was bad law yesterday. it's bad law today. >> reporter: so, what does it all mean? if the law's not repealed by republicans, some of the big provisions go into effect, beginning 2014. every american will be required to have health insurance or pay that tax. insurers will be prohibited from denying coverage because a person has a pre-existing condition. and there will be no annual limits on coverage. >> thanks, terry. let's bring in jake tapper from the white house, as well. jake, let me begin with you. big victory for the president.

one of the ire eye ron /*nys that the chief justice roberts had used as an argument, a tax, that the president rejected. his opponents seizing on it. calling it a huge tax increase. how will the white house defend against that, and do they think this issue will be a political issue winner for them in november? >> republicans think it will be a winner. you have mitt romney raising $4 million online. and you have them talking about how it is a tax, despite president obama telling you in 2009, that it isn't. the fine on those who do not purchase health insurance. but the obama campaign is seeking to cast this within the realm of all the middle class tax cuts they want to provide to the american people. and they're seeking to make this, as you heard in terry's piece there, an example of the president's leadership, doing what's right even when it's unpopular. much in the way george w. bush sold himself in 2004, supporting the iraq war, because you knew he stood for something, even if you disagreed with it. >> jake, take us behind the scenes in the oval office. the president came out of the office to watch the decision. for a few minutes there, he

thought he lost. >> it was a little crazy. cognitive dissidence is what one of his aides called it. he was standing outside the oval office in the area called the outer oval. he looks at a tv. there's a split screen with four different cable channels. two of them erroneously reporting that the health care law had been overturned. he stand there's with a quizzical look on his face. then, his white house counsel his top lawyer comes in and gives him a double thumb's up, tells him that they have upheld it. a weird moment, but as aides say, he was very calm. of course, what are they going to say? >> as you said, terry, everyone was surprised by the role of chief justice roberts. and there's been a lot of speculation over the last 24 hours, in fact, he switched his vote late in the game. >> reporter: it's a detective story. in this opinion, legal scholars are poring through it, searching for and finding clues that something big happened at the last minute that he switched his vote. and what they're finding, is

that the dissent in particular reads like it was originally thinking it was going to be the majority opinion. it's written "we conclude." many signs that chief justice roberts may have switched his vote. >> can't wait to get more on the story on that. >> and you'll have more on the impact of the ruling on "this week." >> absolutely. including vickie kennedy, the widow of ted kennedy. and keith olbermann. >> keith is back. we'll be watching on sunday, george. i'm going to take it away with the news. something that's never happened before in u.s. history. a sitting member of the president's cabinet, the attorney general, has been held in contempt of congress in connection with the gun tracking program "fast and furious." some democrats joined republicans in that vote. what does this mean and what happens next? abc's senior justice correspondent, pierre thomas, joins us here to explain. pierre. >> reporter: good morning, amy. it was a tense day on capitol hill, with the republicans screaming that the justice department's covering up. and democrats saying it was a political witch hunt.

it was a largely partisan vote with democrats seen storming out in protest. a great example of democratic vitriol in washington. as for what this means, in practical terms, other than a frustrated attorney general, not much for the immediate future. the man who runs the justice department will not likely be prosecuted by his own employees. so, look for house republicans to ask a federal judge to give -- to force holder to give up the documents. those proceedings could take months, if not years to resolving. >> pierre thomas in washington, thank you. army investigators are trying to find a motive this morning for a shooting at ft. bragg, north carolina, that left a battalion commander dead. they say a soldier stepped out of formation during a safety briefing, pulled out a handgun, opened fire, and then turned the gun on himself. he survived and is now in custody. flights have resumed at chicago's midway airport, after the lights along the runways mysteriously went out late yesterday, forcing the faa to close that airport. it took five hours to get the

lights back on. 85 flights had to be diverted or delayed. and officials are blaming an airfield equipment problem. you may notice something missing at your favorite beach or public pool this weekend. cities and towns across the country are reporting a lifeguard shortage. they tell "usa today" it's partly because many teens who usually fill those jobs, can no longer afford certification classes. a shocker at wimbledon. two-time winner, rafael nadal has been upset by lukas rosol, ranked 100 in the world. and didn't even qualify for wimbledon his last five tries. nadal has not this early in the grand slam in seven years. and speaking of tennis, umpires may have a new weapon in the war against grunting. maria sharapova is among the ladies famous for the loud racket they make. can we hear it? tennis officials are backing a plan to issue hand-held grunt-o-meter guns to enforce low decibel levels luring the matches.

sharapova says it's a good idea. but not going to stop her from grunting. >> do men not grunt? is this just -- >> it's more women. first one i remember was monica seles. >> like bull frogs. everyone has a different sound. >> it gets ridiculous. i'm sorry, that was above 100 decibels. i mean, what are they going to do? >> thanks for bringing that in. now, to the mayhem on the runway. a flight attendant who apparently lost it with passengers during a delay that lasted nearly a whole day, all caught on camera. in the end, they had to bring cops on the plane to sort everything out. abc's jim avila is here with the saga of a miserable airport experience. jim? >> reporter: good morning, robin. the airline says it's happened again. passengers made unruly by long weather delays, get under the skin of a flight attendant. and since nearly everyone has a cell phone camera these days, it is caught on tape. >> if you have [ bleep ], this is your time. otherwise, you're going to have to fly with jose.

>> reporter: by all accounts, it was chaos on the runway at new york's laguardia airport. >> there's no passenger on here that's comfortable what you said on the intercom. >> reporter: as bad weather grounded american eagle flight 4607, scheduled to take off at just after 1:00 monday afternoon for north carolina. passengers, left sitting in the terminal and on the plane for 4 1/2 hours. tempers flaring. >> this guy's is one that's doing it. >> reporter: at one point, flight attendant, jose seranno, apparently invites passengers to get off the plane, saying something many passengers felt was even more ominous. >> if you have [ bleep ], this is your time. otherwise, you're going to have to fly with jose. >> said something like, this is probably going to be my last flight. >> reporter: hannah and david able, were on board the flight. >> if we did go back in the air, what if he decided i'll open the

door and let a few passengers out. >> reporter: the plane never took off. canceled because the delays took so long, the crew ran out of legal duty time. in a statement, american airlines apologized. saying we do not believe that the passengers' frustrations were always met with a level of service that we expect from our people. and for that, we are truly sorry. >> i retire when i was 38, i don't really care. >> reporter: but the airline also did something rare. providing an e-mail from a first-class passenger, defending the flight attendant and blaming the incident on the most horrible display of passenger aggressiveness towards serrano. four passengers were taken off the plane by police. >> we're going to finish this discussion on the jetway. okay? >> reporter: eventually, everyone went to hotels, awaiting a new flight the next day. some convinced yet another flight attendant -- >> this guy is the one who's doing it. >> reporter: -- had lost it. no one was arrested. the flight attendant was questioned. no word on disciplinary action.

but the faa is investigating. >> once again, it happens. all right, jim, thanks. >> cameras everywhere. we're going to turn to a last fling for california foodies. you see them, they're chowing down on foie gras. it's the fatty duck liver, loved by gourmets, loathed by animal rights activists. the animal lovers won, banning the delicacy after sunday. and david wright looks at how they're coping. >> reporter: it's a debate over a delicacy that in california is about to go away. >> foie gras. foie gras. >> reporter: foie gras, the buttery french treat made from the fattened livers of ducks and geese is about to become illegal. >> sadly, we will be having no more foie gras. >> reporter: because concerns that making it is cruel to the birds. >> i thought i'd never see the day that i can smoke pot openly in san francisco and hide my foie gras habit. >> reporter: foodies are

here's a look at the high temperatures around the nation today. here's the record heat that's possible. atlanta, memphis, washington, kansas city, other places will be coming in with the heat, as well, today. there's no getting away from it. in that heat, strong to severe storms that light up. not only ones in the morning in the northeast, but the ones in the heartland in the middle of the day with the cold front.

park. not worrying about the storms that went through. >> went on through. also this morning, the battle over the millionaire's money. his wife and mother in court, facing off over his $100 million fortune. who won? also, the queen's bling. look at this. 10,000 royal diamonds. a dazzling display of what kate could one day call her crowning glory. >> that's some kind of bling. first, the scandal breaking in the sports world. an extortion plot against former nba star and coach mark jackson. police say an exstripper and accomplice, tried to blackmail jackson to keep the relationship under wraps. abc's john schriffen is here with much more on this story. >> reporter: good morning. an interesting situation. golden state warriors head coach, mark jackson, is known for his squeaky-clean image. he's a pastor, a husband and a father of four. but this morning, that image has been tarnished by a scandal

jackson was willing to pay to keep quiet. the fbi says this woman, alexis adams, a former stripper, seen here in her modeling photos, wanted to shake down her former lover. and was willing to go to great lengths to do it. her target? mark jackson, a former nba star. >> antonio davis. >> reporter: now, the head coach of the golden state warriors. >> direct line. come on. >> reporter: the fbi says adams and this man, marcus shaw, pressed jackson to pay them thousands of dollars to stop them from making embarrassing nude photos of him public. >> the combination of vulnerability, high exposure and wealth make people like him primary targets. >> reporter: the photos of jackson were apparently real. six years ago, he had an affair with adams, while working as an nba announcer in new jersey. >> we fell in love with what the nets did in the second quarter. >> reporter: when jackson ended the affair and told his wife, the fbi says an angry adams sent

jackson's wife the photos. but the couple stayed together. jackson, who was also a minister, often talks about his family. >> my wife is an incredible woman. an incredible mom, that sets an example. >> reporter: on april 3rd, jackson says he was approached by marcus shaw in a memphis hotel. shaw showed him the photos, as well as a cd he says contained recordings of voicemail messages during the affair. jackson eventually gave shaw $5,000 cash for the folder, which jackson destroyed. but the fbi says two weeks later, jackson was pressured for more money. in an e-mail to his wife, which read in part, do you want to purchase these pictures before i sell them. jackson responded, quote, i thought we took care of this in memphis. you know i value my reputation. i'll give you $200,000 to keep this quiet. afraid it wasn't over, jackson went to the fbi. >> the fbi were able to take the e-mails and track them right to the two individuals involved. they then pulled up their

telephone numbers and placed both of them clearly inside this extortion. >> reporter: in a statement released late thursday, jackson wrote, quote, i made some egregious errors. i apologize for any embarrassment i may have caused my family, friends and of course, the warriors. alexis adams was released from custody thursday, after posting a $25,000 bond. but shaw remains behind bars because he has a prior conviction for aggravated robbery in tennessee in 1996, for which he was sentenced to 12 years in prison. robin, according to court records. the latest on the missing millionaire out of miami and the family battle over his $100 million fortune. aguiar disappeared a week ago. and his wife and mom were fighting over his money. there was a lot of emotion in that courtroom. >> reporter: absolutely. a family feud boiling over in court.

the two women who are grieving over the disappearance of their beloved husband and son, couldn't put their differences aside, even in court. in the end, though, the judge didn't give either one what they were fighting for. the wife and mother of philanthropist, guma aguiar, were in court battling over control of his assets. >> ellen aguiar is an enabler, who enabled guma to do these things that were irrational. >> reporter: aguiar's mother, ellen, sat stoned-faced, as attorneys for both sides traded accusations. >> did not want guma to be concerned over his assets. >> ellen has been on the gravy train. >> reporter: at one point, aguiar's wife, jamie, broke down in tears, running from the courtroom. aguiar, a 35-year-old father of

four, was last seen his home june 19th. almost seven hours later, his abandoned fishing boat was washed ashore, on a ft. lauderdale beach. the engine running, lights on. aguiar's cell phone and wallet onboard. but as the coast guard searched for him, his wife and mother began fighting over his money. >> he told her that he just had told his wife, he would be filing for divorce in the morning. this is jamie aguiar has a conflict. >> reporter: but jamie aguiar says she and guma were very much in love and working through their marriage. and his mother just wants his cash. >> there is no truth to anything that was said in the courtroom about me. we just wanted to see it back. >> reporter: in the end, the judge appointed a third party to be in control. essentially that is what
